1. Introduction

Welcome to SoftMeadowLane ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and the website at softmeadowlane.sbs (the "Service") operated by SoftMeadowLane.

By securing a charter or using our Service, you consent to these Terms. If you do not agree with any part of these terms, you should refrain from using the Service.

2. Service Overview

SoftMeadowLane offers exclusive yacht charter services, which include:

• Day-long yacht rentals
• Evening cruises
• Business retreats
• Exclusive gatherings
• Extended charters

Service availability is contingent on weather conditions. We retain the right to alter or cease services as needed.

3. Booking and Reservations

3.1 Booking Process

For charter booking, you need to:

• Be 18 years old or over
• Supply valid and precise details
• Submit the required deposit as detailed in your booking confirmation
• Acknowledge these Terms & Conditions

3.2 Confirmation

Confirmation of your booking happens once payment is received and you obtain our written acknowledgment. We reserve the right to deny service at our sole discretion.

3.3 Availability

Charter availability is reliant on the availability of vessels and suitable weather conditions. We will try to accommodate your requested dates and times where possible.

4. Payment Terms

4.1 Pricing

All stated prices are in € and are inclusive of relevant taxes unless stated otherwise. Prices may be adjusted without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the total cost of the charter is due upon booking
• Balance: Payable 48 hours before the departure of the charter
• Extra charges (if applicable): Payable upon charter completion

4.3 Payment Methods

We accept major credit cards, bank transfers, and certified cheques. Payment processing is carried out using secure, encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With more than 72 hours before departure: Full refund minus processing fees
• Between 24-72 hours prior to departure: 50% refund
• Less than 24 hours prior to departure: No refund

5.2 Weather Cancellations

Should our captain determine weather conditions to be unsafe, we will propose to:

• Reschedule your charter for the nearest available slot with no additional charge
• Issue a full refund if rescheduling cannot be accommodated

5.3 Mechanical Issues

If mechanical problems occur with your designated vessel, we will endeavour to provide a compatible replacement. If that is not an option, we will give a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All passengers must:

• Adhere to all directions given by the crew
• Don safety gear when necessary
• Disclose any health conditions that could impact their safety
• Stay within the assigned areas of the vessel

6.2 Prohibited Items

The following items are not allowed on board:

• Glass items
• Illegal substances
• Weapons or firearms
• Alcoholic substances beyond a moderate quantity
• Pets (unless prior approval is granted)

6.3 Conduct

Passengers are expected to behave respectfully. We reserve the right to discontinue a charter prematurely with no refund if passengers' conduct endangers safety or interrupts others' enjoyment.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the cost paid for the charter. We assume no responsibility for:

• Personal injuries caused by passenger negligence
• Theft or impairment of personal belongings
• Indirect, incidental, or punitive losses
• Delays due to weather or situations out of our control

7.2 Insurance Coverage

Comprehensive marine insurance is maintained by us, covering our vessels and activities. Passengers shoulder the responsibility of their own travel and personal insurance.

7.3 Assumption of Risk

By engaging in our charter services, you recognize the inherent hazards associated with water activities and accept full accountability for your personal safety and welfare.

8. Modifications and Itinerary Changes

We maintain the right to alter itineraries, courses, or timetables due to weather conditions, security concerns, or operational necessities. We will strive for comparable alternatives where feasible.

9. Force Majeure

Occurrences beyond our control such as severe weather, natural catastrophes, governmental edicts, port shutdowns, and mechanical failures, that result in delays, cancellations, or changes are not our liability.

10. Privacy and Data Protection

Your personal data is managed in accordance with our Privacy Policy. By utilizing our services, you give consent to the collection and usage of your data as delineated in the Privacy Policy.

11. Intellectual Property

Our website content, including text, imagery, logos, and graphics, is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative work is forbidden without our express permission.

12. Governing Law

These Terms comply with the laws of France. Any disputes will be settled in the courts of Cannes, France.

13. Changes to Terms

We may revise these Terms from time to time. Amendments will be made public on our website and indicated with an updated revision date. Your continued service use signifies agreement to the amended terms.
